James Hosking Serves on Program Faculty of NYSBA Commercial Arbitration Training

June 2019 — James Hosking contributed as a panelist for the “Advocates’ Best Practices in Selecting Arbitrators” and “Introduction to International Arbitration” modules at the New York State Bar Associations’ recent Three-Day Commercial Arbitration Training for Arbitrators and Counsel: Comprehensive Training for the Conducting of Commercial Arbitrations Pursuant to Contemporary Best Practices, which took place June 17-19, 2019 at the Benjamin N. Cardozo School of Law.

The training is intended for new arbitrators and seasoned arbitrators interested in taking their skills to the next level, as well as for litigators interested in learning how best to represent clients in arbitrations. The training was conducted by seasoned arbitrators, counsel, arbitration administrators, and academics, focusing on best practices for conducting commercial arbitrations in an economical, expeditious and fair manner.

Aníbal Sabater Speaks at the Annual ITA Workshop and Annual Meeting in Dallas

June 2019 – On June 20, 2019, Aníbal Sabater will speak at the 31st Annual Institute for Transnational Arbitration (ITA) Workshop and Annual Meeting in Dallas. He is moderating a panel discussion on “Changed Circumstances: Practical Insights from Seasoned Arbitration Counsel and Arbitrators.” The panel will address the challenges of changed circumstance and associated legal doctrines, and how they are addressed in contract and investment treaty arbitration.

The Annual ITA Workshop is considered the best U.S. conference to interact directly with leading arbitrators, practitioners, and academics from around the world. This year, 250-300 participants from more than 30 countries are attending the conference.

A division of The Center for American and International Law, ITA provides advanced, continuing education for lawyers, judges and other professionals concerned with transnational arbitration of commercial and investment disputes. Through its programs, scholarly publications and membership activities, ITA has become an important global forum on contemporary issues in the field of transnational arbitration.

James Hosking & Gretta Walters Speak on ICDR’s IA Rules Since the 2014 Amendments

June 2019 – James Hosking and Gretta Walters will be speaking at an upcoming panel discussion on the ICDR’s International Arbitration Rules, focused on practical experience with the Rules since they were substantially amended in 2014.  The panel will draw on institutional insights as well as contributions from Martin Gusy and James Hosking, co-authors of the newly-released Second Edition of “A Guide to The ICDR International Arbitration Rules,” and a look to the future with Y&I Global Advisory Board member Gretta Walters.  Attendees can also purchase a copy of the book at a discount.

Yasmine Lahlou Speaks at GAR Live Stockholm

May 2019 – Last week, Yasmine Lahlou participated in a panel discussion on “How to get the right chemistry when choosing an arbitral tribunal” at the 4th Annual GAR Live Stockholm. The panel spoke about the importance of tribunal chemistry and analyzed perspectives from the claimant, respondent, co-arbitrator, and chair.

Gretta Walters to Speak on Panel Regarding Developments in Swedish Arbitration in Stockholm

May 2019 – On Monday, May 20th, Gretta Walters will speak at the Swedish Arbitration Association (SAA) and the Arbitration Institute of the Stockholm Chamber of Commerce (SCC) Half Day Conference in Stockholm. Gretta will serve on a panel to discuss “Developments in Swedish arbitration: Court procedures, SCC rules and practice.” The half day conference will focus on recent key revisions modernizing the Swedish Arbitration Act, and recently revised SCC Rules and new court procedures.

The SAA is an organization for lawyers worldwide engaged in arbitration that seeks to promote the interest and knowledge of arbitration as a dispute resolution method, Swedish and international arbitration law and Sweden as an international arbitration venue. The SCC is one of the world’s leading forums for dispute resolution.

Chaffetz Lindsey Out in Force at the IBA Annual Litigation Forum

May 2019 – Chaffetz Lindsey is proud to be a member of the Organizing Committee, and a sponsor of the conference dinner, for this year’s IBA Annual Litigation Forum in Berlin from May 8th – 10th.  Peter Chaffetz, Andreas Frischknecht, and Rainbow Willard will be in attendance.

Andy is co-chair of the Young Litigators Forum, which is putting on a seminar on Wednesday afternoon focusing on witness examination techniques.  Andy will also co-chair a panel discussion on Cryptocurrencies, which will explore both foundational concepts and cutting-edge issues in cryptocurrency regulation and litigation on Friday morning.

Peter is an officer on the IBA Litigation Committee.

The IBA Annual Litigation Forum addresses legal, practical, and procedural issues involved in conducting litigation. This year’s conference will focus on “Disruption in Litigation – New Types of Disputes in a New World Order.”

James Hosking Speaks at the ICC’s Annual West Coast Conference

On April 29th, 2019, James Hosking spoke at the ICC’s Annual West Coast Conference in San Francisco. Hosted by Arnold & Porter LLP, the conference addressed hot topics and recent developments in international arbitration of interest to practitioners on the West Coast. James led a discussion about Emergency Arbitrator Proceedings, providing insights into how to administer these procedures and analyzing key takeaways from the newly released ICC Commission Report on Emergency Arbitrator Proceedings.

James, is co-chair of the Task Force on Emergency Arbitrator Proceedings that produced the report, which offers insight on procedural and substantive issues in emergency arbitrator proceedings—from identifying emerging trends to collating practical tips to facilitate the use of EA proceedings. The report is based on an empirical study of the first eighty ICC EA applications and presents key data on issues such as challenges to jurisdiction, substantive standards applied, success rates, and post-application enforcement.  The report also summarizes responses from forty-five ICC National Committees addressing questions regarding the status of EA proceedings under national laws.

According to James, “While acknowledging the flexibility provided under the ICC rules, the task force has been able to distill practical advice on how best to handle emergency arbitration proceedings, drawing on the combined experience of arbitrators, counsel, commercial users, and the institution itself.  There is no other comparable resource available to the international arbitration community.”

Gretta Walters to Moderate a Panel Discussion on “The Art Of Advocacy: Tips, Tricks & War Stories”

April 2019 – On Monday, April 29th, Gretta Walters will moderate a panel discussion at Baker McKenzie on “The Art of Advocacy: Tips, Tricks and War Stories.” Leading arbitration advocates will discuss the art of written and oral advocacy, as well as persuasion in international arbitration.

The event is hosted by Baker McKenzie, the International Centre for Dispute Resolution (ICDR) Y&I, the Young ArbitralWomen Practitioners, and the Arbitration Pledge. Gretta is a member of the ICDR Y&I Global Advisory Board, which is a networking group for arbitration and other alternative dispute resolution practitioners under 40.

April 2019 – On Monday, April 15th, Gretta Walters will speak on a panel at “A Seminar by KCAB International: Demystifying the Arbitral Tribunal – Arbitrator Selection, Challenge, and Dynamics.” The panel discussion will address key issues, including how institutions and practitioners should select arbitrators, the grounds and processes for challenging arbitrators, and how to ensure good tribunal dynamics.

Yasmine Lahlou Speaks on Panel About Diversity in Alternative Dispute Resolution

April 2019 – On Wednesday, April 10th, Yasmine Lahlou participated in a panel discussion on “Constituting the Right Tribunal: Different Voices for Optimal Results” at the ABA Section of International Law 2019 Annual Conference in Washington D.C. The panel focused the elimination of bias in the profession, and explored the advantages of tribunals that include a diverse group of people, including not only women, but also practitioners from different legal traditions, and even different professions.

The discussion is part of the America Bar Association’s effort to diversify Alternative Dispute Resolution.

Gretta Walters to Participate in the 15th Annual ICDR Y&I Coffee House Debate

April 2019 – On Sunday, April 14th, Gretta Walters will participate in the 15th Annual ICDR Y&I Coffee House Debate at Palais Daun-Kinsky in Vienna, Austria. Gretta will join other panelists to discuss whether or not arbitrators should consider evidence that has been unlawfully obtained, as well as if arbitrators must be more inquisitive to ensure efficiency and effectiveness, reduce document production, limit submissions and lengthy hearing dates, impose shorter time frames, and promote settlement.

The event is sponsored by Chaffetz Lindsey and was co-founded by partner James Hosking. It takes place on the occasion of the 26th Annual Willem C. Vis International Commercial Arbitration Moot, which aims to foster the study of international commercial law and arbitration for resolution of international business disputes through its application to a concrete problem of a client and to train law leaders of tomorrow in methods of alternative dispute resolution. Gretta will also be attending the 26th Annual Willem C. Vis International Commercial Arbitration Moot as the co-coach of the New York University Law School team and as an arbitrator.
